This Shipping Policy applies to orders placed through bgxperformance.com once online ordering becomes available and forms part of the BGX Performance Terms of Service. Products are supplied strictly for lawful in-vitro laboratory research and are not for human or animal consumption or use.
We ship only to destinations made available during checkout. We may decline or cancel an order when a product cannot lawfully or safely be shipped to the requested destination, when verification is incomplete, or when a carrier or fulfillment restriction applies. Customers are responsible for confirming that they may lawfully purchase, import, receive, possess, and handle each product in their jurisdiction.
Orders may require payment, inventory, address, fraud-prevention, age, intended-use, or compliance review before shipment. Processing and delivery estimates shown at checkout or in an order confirmation are estimates only and are not guarantees. Weekends, holidays, weather, carrier disruptions, customs review, high order volume, and events outside our reasonable control may cause delays.
Available services and shipping charges are calculated and displayed at checkout. Eligible U.S. orders with a merchandise subtotal over $300 after discounts and before taxes qualify for free standard shipping. Expedited services, special handling, reshipments, duties, taxes, and international charges are not included unless expressly stated at checkout.
You are responsible for providing a complete, lawful, and secure delivery address. Contact support@bgxperformance.com immediately if an address needs correction. We cannot guarantee a change or cancellation after an order enters processing, and additional carrier or reshipment charges may apply when an incorrect or incomplete address was supplied.
Tracking information will be provided when available. A carrier scan, delivery date, or tracking status is generated by the carrier and may be delayed or inaccurate. Customers should monitor tracking and arrange prompt, secure receipt. BGX is not responsible for carrier delays or for loss after confirmed delivery except where applicable law requires otherwise.
Inspect the shipment promptly after delivery. If a package arrives damaged, an item is missing, or the wrong item was sent, contact support promptly with the order number, a description of the issue, and clear photographs of the shipping label, exterior packaging, internal packaging, and affected product. Keep all packaging and do not open, use, reconstitute, alter, or discard the affected product while the claim is reviewed. Available remedies are governed by the No-Refund Policy and applicable law.
International availability is not guaranteed. The recipient is responsible for import eligibility, permits, customs clearance, duties, taxes, brokerage fees, and other local requirements. BGX does not guarantee customs release and is not responsible for delays, seizure, refusal, return, or destruction by customs or another authority except where applicable law provides otherwise.

This No-Refund Policy applies to all purchases from BGX Performance and forms part of the Terms of Service. By placing an order, you acknowledge that the products are specialized research materials sold strictly for lawful in-vitro laboratory research.
Except where applicable law requires otherwise, orders are not eligible for return, refund, exchange, or store credit because of a change of mind, an ordering mistake, failure to review product details, lack of institutional approval, inability to use a product, dissatisfaction with research results, carrier delay, customs delay or refusal, or failure to comply with storage, handling, import, or research-use requirements.
Contact support@bgxperformance.com immediately to request an order change or cancellation. A request is not guaranteed. Once an order has entered processing, fulfillment, or shipment, it cannot be canceled or changed. If BGX approves a cancellation before fulfillment and payment has already been captured, BGX will reverse or refund the canceled charge to the original payment method.
A verified shipping damage claim, missing item, or BGX fulfillment error does not automatically qualify for a cash refund. Contact support promptly after delivery, retain all packaging, and provide the order number and clear photographs requested for review. Do not open, use, reconstitute, alter, or discard the affected product. If BGX verifies the claim, BGX may provide a replacement, reship the correct item, issue store credit, or provide another remedy required by applicable law.
Packages refused by the recipient, returned because of an incorrect or incomplete address, left unclaimed, rejected by customs, or otherwise made undeliverable for reasons outside BGX's control are not eligible for a refund except where required by law. If reshipment is available, the customer may be responsible for additional shipping, handling, duties, and carrier charges.
Contact support before initiating a payment dispute so BGX can review the order and any available remedy. This section does not limit any non-waivable right provided by applicable law or a payment-network rule.
Nothing in this policy excludes, limits, or waives a warranty, remedy, or consumer right that cannot lawfully be excluded, limited, or waived. Where this policy conflicts with mandatory law, the mandatory law controls.

By visiting the Site, submitting information, or—once ordering is available—purchasing a product, you agree to these Terms, the Privacy Policy, and the Research Use Only Disclaimer, each incorporated into these Terms. If you do not agree, do not use the Site.
You must be at least 21 years old and legally capable of entering a binding agreement. If you act for a laboratory, institution, company, or other organization, you represent that you have authority to bind that organization. Products may be purchased only by qualified researchers or authorized personnel for legitimate in-vitro research.
Every product is sold strictly as a laboratory research material. Products are not medicines, compounded drugs, dietary supplements, foods, cosmetics, household products, medical devices, or veterinary products. You must not ingest, inject, inhale, apply, administer, introduce, or otherwise use any product in or on a human or animal. Clinical, diagnostic, therapeutic, recreational, cosmetic, veterinary, and personal uses are prohibited.
You are solely responsible for determining whether you may lawfully purchase, import, possess, store, transfer, and use each product in your jurisdiction and research setting. A label or Site statement does not replace permits, licenses, institutional approvals, safety reviews, or other requirements applicable to your activities.
By ordering, you represent and warrant that: (a) all information you provide is accurate; (b) the order is for lawful in-vitro research only; (c) you possess the training, facilities, equipment, and authorization needed to handle the materials; (d) you will follow applicable laws, safety standards, product documentation, and institutional procedures; (e) you will not seek or rely on dosing, administration, cycle, treatment, or medical guidance; and (f) you will prevent diversion, unauthorized access, and prohibited use.
Site content, product descriptions, literature references, research summaries, customer support, and Certificates of Analysis are provided for general laboratory and informational purposes. They do not constitute medical, veterinary, diagnostic, legal, safety, or other professional advice and do not recommend any use in humans or animals.
We seek to describe products accurately, but images, packaging, specifications, availability, pricing, and documentation may be corrected or updated. Research results and third-party literature do not guarantee performance in any particular experiment. A Certificate of Analysis relates only to the identified batch and reported tests. You are responsible for confirming identity, suitability, compatibility, and handling requirements before use.
Submitting an order is an offer to purchase. You may not misuse the Site; interfere with security or operation; submit false information; infringe intellectual-property rights; scrape or copy content for a competing service; attempt unauthorized access; use products unlawfully; resell or transfer products for prohibited use; market products for human or animal use; or use Site content to promote dosage, administration, treatment, or unapproved health claims.
The Site, brand elements, text, graphics, photographs, layout, software, and other content are owned by or licensed to BGX and protected by applicable intellectual-property laws. We grant you a limited, revocable, nonexclusive right to use the Site for lawful personal or internal business research purchasing. No other rights are granted.
The Site may link to or rely on third-party hosting, payment, shipping, analytics, scientific databases, and other services. Third parties operate under their own terms and privacy practices. BGX does not control and is not responsible for third-party content, availability, security, or conduct.
To the fullest extent permitted by law, the Site, content, and products are provided “as is” and “as available.” BGX disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted Site operation, error-free content, or suitability of a product for a particular protocol. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.
To the fullest extent permitted by law, BGX and its owners, officers, employees, contractors, suppliers, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits, data, research, or business opportunity; personal misuse; unauthorized use; or losses arising from improper storage, handling, transfer, or application. BGX’s aggregate liability arising from an order will not exceed the amount paid for the product giving rise to the claim. These limits do not apply where prohibited by law.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless BGX and its owners, officers, employees, contractors, suppliers, and agents from third-party claims, losses, liabilities, penalties, damages, and reasonable costs arising from your breach of these Terms, unlawful conduct, prohibited use, negligent handling, unauthorized resale or transfer, or violation of another person’s rights.
We may suspend access, refuse service, cancel orders, preserve records, or restrict future purchases when we reasonably suspect fraud, diversion, prohibited use, safety concerns, or legal violations. We may disclose information to regulators, law enforcement, courts, payment providers, carriers, or other parties when reasonably necessary to comply with law, protect rights or safety, investigate misuse, or enforce these Terms.
BGX is not responsible for delay or failure caused by events beyond reasonable control, including carrier disruption, natural disaster, fire, labor dispute, epidemic, war, civil unrest, cyberattack, supplier interruption, government action, regulatory change, or utility and network failure.
These Terms are governed by applicable United States law and the law of the state in which BGX is legally organized, without regard to conflict-of-law rules, except where mandatory consumer law requires otherwise. Before filing a claim, you agree to contact support@bgxperformance.com and make a good-faith effort to resolve the dispute informally. Any court proceeding must be brought in a court with lawful jurisdiction over BGX’s principal place of business, unless applicable law provides another venue.
If a provision is unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a business transfer or by operation of law. These Terms and incorporated policies form the entire agreement regarding the Site and orders, except for additional written terms expressly accepted by BGX.

BGX does not sell personal information for money. We do not knowingly sell or share personal information of anyone under 21. If our use of analytics or advertising technology is considered a “sale,” “sharing,” or targeted advertising under applicable state law, eligible individuals may request an opt-out by contacting us. Where legally required and technically supported, we will also process recognized browser-based opt-out preference signals, such as Global Privacy Control.
We retain information for as long as reasonably necessary for the purposes described above, including order fulfillment, support, safety, fraud prevention, dispute resolution, tax and accounting obligations, regulatory compliance, and enforcement. Retention periods vary by record type and legal requirement. We may delete, de-identify, or aggregate information when it is no longer reasonably needed.

This Research Use Only Disclaimer (“RUO Disclaimer”) applies to every product, page, communication, order, and shipment from BGX Performance. It forms part of the Terms of Service. If you do not accept these restrictions, do not access product information or place an order.
Products are supplied exclusively as laboratory materials for legitimate in-vitro research, analytical testing, method development, or comparable non-clinical work conducted outside a living human or animal body in an appropriately controlled research environment.
Products are not offered as drugs, compounded preparations, medicines, dietary supplements, foods, cosmetics, medical devices, or veterinary products. Unless expressly stated otherwise for a specific lawful classification, products have not been evaluated or approved by the U.S. Food and Drug Administration for human or animal diagnosis, treatment, cure, mitigation, prevention, administration, or consumption.
Products must not be ingested, injected, inhaled, implanted, reconstituted for administration, topically applied, self-administered, administered to another person, administered to an animal, used for compounding, used in food or cosmetics, used for athletic or body-composition purposes, or used in any clinical, therapeutic, diagnostic, veterinary, recreational, household, or personal setting.
Purchasers must be at least 21 years old, legally authorized to acquire the materials, and qualified through education, training, supervision, or institutional role to handle research chemicals safely. A purchaser must have appropriate facilities, personal protective equipment, containment, storage, disposal procedures, and emergency protocols.
By ordering, you certify that the products will be used only for lawful in-vitro research; you will not use them in or on humans or animals; you will not seek dosage or administration advice; you will comply with all federal, state, local, institutional, and international requirements; and you accept responsibility for secure receipt, handling, storage, documentation, transfer, and disposal.

You may not resell, relabel, redistribute, transfer, or supply a product to any person or entity for prohibited, unlawful, or unverified use. You must maintain reasonable controls against diversion and unauthorized access. BGX may refuse service, cancel an order, request verification, preserve records, or report suspected unlawful activity when permitted or required by law.
